Terms of Service

These Terms govern your access to and use of mistVCC, including the website, the user panel, virtual cards, account balance and all related services. Please read them carefully: they limit our liability and set out your responsibilities.

1Acceptance of these Terms#

By creating an account, ticking the acceptance box at registration, adding funds or using any part of the Service, you confirm that you have read, understood and agree to be bound by these Terms of Service and Acceptable Use rules (together, the “Terms”). If you do not agree, you must not use the Service.

These Terms form a legally binding agreement between you and mistVCC (“mistVCC”, “we”, “us”, “our”), a service of the Mist Network. Where you use the Service on behalf of a company or other organisation, you confirm that you are authorised to bind it, and “you” includes that organisation.

2Definitions#

  • Service — the mistVCC website, user panel, Telegram bot and any related features, tools, support and communications.
  • Card — a virtual payment card made available to you through the Service.
  • Issuer — the third-party bank, licensed card issuer, e-money institution and/or programme manager that actually issues and operates a Card.
  • Payment Network — card schemes such as Visa or Mastercard and any processor, acquirer or intermediary involved in a transaction.
  • Account Balance — the USD-denominated internal balance shown in your mistVCC account, used to pay fees and to load Cards.
  • Card Balance — the funds loaded onto a specific Card.
  • Merchant — any website, platform, service or seller at which you attempt to use a Card.

3Our role: reseller and intermediary#

mistVCC is a reseller and technical intermediary. We are not a bank, credit institution, e-money institution, payment institution, exchange or card issuer. Cards are issued and operated by third-party Issuers through their own programmes, and every Card is subject to the rules of the relevant Issuer and Payment Network in addition to these Terms.

We do not control, and are not responsible for, the decisions, systems, availability, policies or actions of Issuers, Payment Networks, crypto networks, payment processors or Merchants. Card features — including the BIN, issuing country, currency, limits, supported merchants and 3-D Secure behaviour — are determined by the Issuer and may change at any time without notice.

Nothing in the Service constitutes financial, investment, legal or tax advice.

4Eligibility and your account#

You must have reached the age of legal majority and have full legal capacity to enter into binding contracts. You must not use the Service if doing so would be unlawful for you, or if you have previously been suspended or banned from the Service.

  • You must provide accurate, current and complete information and keep it up to date.
  • You are responsible for keeping your password, devices, email account and Telegram account secure. All activity carried out through your account is deemed to be authorised by you.
  • You must not sell, rent, share or transfer your account or Cards to anyone else.
  • Creating multiple accounts to circumvent limits, fees, promotions, referral rules or restrictions is not permitted.
  • You must notify support immediately if you suspect unauthorised access to your account or Cards.

5Identity verification (KYC)#

We or the Issuer may require you to verify your identity, the source of your funds or the purpose of your use at any time, including before issuing a Card, processing a top-up or withdrawal, or after a transaction has been completed. Requested information may include identity documents, a selfie, proof of address and business information.

Until verification is completed to our or the Issuer’s satisfaction, we may limit, suspend or refuse any part of the Service. We may share verification data with Issuers and other parties where this is required to provide the Service or by applicable law. Submitting false, altered or third-party documents is a serious breach of these Terms.

6Account Balance, top-ups and crypto payments#

Account and Card Balances are denominated in US dollars (USD). Your Account Balance is a prepaid service credit, not a bank deposit or savings product; it does not earn interest and is not covered by any deposit guarantee scheme. It may only be used within the Service and cannot be transferred to another user.

  • Top-ups made with cryptocurrency are final and irreversible once confirmed on the relevant blockchain. We cannot cancel, reverse or recall a crypto transaction.
  • All blockchain network fees, exchange spreads and third-party processing costs are borne by you.
  • You are solely responsible for sending the correct asset, on the correct network, to the correct address, with any required memo or tag, before the invoice expires. Funds sent to a wrong address, on an unsupported network, in an unsupported asset, below the minimum amount or after expiry may be permanently lost, and we accept no liability for such losses. Any recovery attempt is at our sole discretion and may incur costs.
  • The USD amount credited is the amount confirmed by our payment processor. Underpayments may be credited at the received value or held until resolved.
  • Crediting may be delayed by network congestion, confirmations, processor checks or compliance reviews.

7Cards#

Card issuance is subject to availability, your account status, verification and the Issuer’s approval. We may change, limit or withdraw any card product, BIN or feature at any time.

  • We do not guarantee that any Card will be accepted by any Merchant, for any purpose, in any place or at any time. Merchants and Payment Networks may decline transactions for reasons outside our control.
  • An Issuer or Payment Network may decline, reverse, freeze, block or close a Card or transaction at any time, including for risk or compliance reasons, and may not disclose the reason to us or to you.
  • You must keep Card details (number, expiry date, CVV) confidential. Anyone who obtains them may be able to use the Card; losses resulting from disclosure are your responsibility.
  • You are responsible for every transaction made with your Cards, including recurring payments, subscriptions and pre-authorisations, and for keeping sufficient Card Balance to cover them.
  • The balance shown in the panel may be a cached figure and may differ from the Issuer’s ledger; the Issuer’s records prevail.

8Fees and pricing#

Applicable fees — such as card issuance fees, top-up fees and service fees — are shown in the panel before you confirm an action. By confirming, you agree to pay them. Fees may be deducted from your Account Balance or Card Balance.

  • We may change our fees and prices at any time. Changes apply to actions taken after the change is published and do not affect actions already completed.
  • Card issuance fees are non-refundable, including where a Card is later declined by a Merchant, blocked, closed or not used.
  • Issuers, Payment Networks, Merchants and crypto networks may charge their own fees (for example foreign-exchange, cross-border, decline or network fees). Such fees are outside our control and are borne by you.

9Refunds#

Except where expressly stated otherwise in these Terms, all payments and fees are final. Refunds of any amount are granted only at our sole discretion and do not create an obligation for future cases.

Refunds from a Merchant for a Card purchase are processed by the Merchant, the Payment Network and the Issuer according to their own rules and timelines; we do not guarantee that a Merchant refund will be received. Disputes and chargebacks are subject to the Issuer’s and Payment Network’s procedures and may not be available for all Cards or transactions.

10Acceptable use#

You are solely responsible for ensuring that your use of the Service and of every Card is lawful under all laws and regulations that apply to you, and that it complies with the terms of every Merchant and platform you pay. We do not review, and accept no responsibility for, the legality of your purchases or business.

You must not use the Service, directly or indirectly, for or in connection with:

  • any illegal activity, or the purchase or sale of illegal goods or services;
  • fraud, scams, phishing, identity theft, use of stolen or third-party data, or deceiving any Merchant, platform or person;
  • money laundering, terrorist financing, or concealing the origin of funds;
  • evading sanctions, export controls or other legal restrictions;
  • gambling, betting or lotteries where unlawful or not properly licensed;
  • weapons, explosives, drugs and controlled substances, or counterfeit goods;
  • child sexual abuse material or any content that exploits minors, and non-consensual or illegal adult content;
  • intentionally abusing Merchant refund, chargeback, free-trial or promotion mechanisms;
  • circumventing a platform’s bans, restrictions, verification or payment rules in breach of its terms;
  • reselling Cards or the Service without our written consent;
  • attacking, scraping, reverse-engineering or overloading the Service, or attempting to access other users’ data;
  • any other activity that we, an Issuer or a Payment Network reasonably consider high-risk, abusive or harmful.

11Monitoring, suspension and termination#

We may monitor activity on the Service to protect users, Issuers and ourselves. We may, at our sole discretion and with or without prior notice:

  • refuse, delay or reverse any top-up, card issuance, card load or withdrawal;
  • freeze, block or close any Card, or suspend or terminate your account;
  • withhold funds in your Account Balance or Card Balances for as long as reasonably necessary to complete an investigation, or as required by an Issuer, Payment Network or applicable law;
  • report activity to Issuers, Payment Networks or competent authorities where required;
  • require additional verification before restoring access.

Where we determine that funds are connected to fraud, prohibited use or a breach of these Terms, we may use them to cover losses, fees, chargebacks and penalties incurred, and handle any remainder as required by the Issuer or applicable law. You may close your account at any time by contacting support; outstanding obligations survive closure.

12Third-party services and platforms#

The Service relies on third parties, including Issuers, Payment Networks, crypto payment processors, hosting and communication providers. Their services are governed by their own terms and we are not responsible for their acts, omissions, outages or decisions.

We do not guarantee that any advertising platform, AI service, marketplace or other platform will accept a Card or keep your account active. Suspension, restriction or banning of your accounts on any third-party platform — including advertising accounts, business managers and payment profiles — is outside our control and is not our responsibility, regardless of whether a Card was used.

13Disclaimer of warranties#

The Service and all Cards are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability or uninterrupted operation. We do not warrant that the Service will be error-free, secure or continuously available, or that any Card will function for any particular Merchant or purpose.

14Limitation of liability#

To the maximum extent permitted by applicable law, mistVCC, the Mist Network and their owners, staff, partners and suppliers shall not be liable for any loss or damage arising from or related to:

  • transactions declined, reversed or delayed by a Merchant, Issuer or Payment Network;
  • Cards being frozen, blocked, closed, reissued or discontinued by an Issuer or Payment Network, or changes to card products and BINs;
  • acts, omissions, insolvency, outages or policy changes of Issuers, Payment Networks, processors or other third parties;
  • misuse of the Service, compromised credentials, disclosure of Card details, or unauthorised transactions not caused by our proven gross negligence;
  • chargebacks, disputes, Merchant refunds or the outcome of any dispute procedure;
  • suspension or banning of your accounts on advertising, AI or other third-party platforms;
  • crypto network congestion, forks, failed or delayed transactions, price movements, or funds sent to a wrong address, network or asset;
  • any indirect, incidental, special, consequential, exemplary or punitive damages, or loss of profits, revenue, business, data, goodwill or opportunity.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Service is limited to the fees you actually paid to us for the Service during the one (1) month immediately preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

15Indemnification#

You agree to indemnify and hold harmless mistVCC, the Mist Network and their owners, staff and partners from any claims, losses, liabilities, fines, chargebacks, costs and expenses (including reasonable legal fees) arising from your use of the Service or Cards, your breach of these Terms, or your violation of any law or third-party right.

16Inactive accounts and abuse#

If your account shows no login or transaction activity for an extended period (for example twelve (12) months), we may close unused Cards, restrict the account and, after attempting to notify you at your registered email address, close it. Any remaining balance will be handled in accordance with these Terms, the Issuer’s rules and applicable law.

We may cancel promotions, referral rewards, bonuses or discounts obtained through abuse, self-referral, multiple accounts or other manipulation, and recover any value obtained in this way.

17Communications#

You agree to receive communications electronically — by email, through the user panel and support tickets, and via our official Telegram channels and bot. Notices sent to your registered email address or displayed in the panel are deemed delivered when sent or published. Please keep your contact details up to date.

Our official support is listed on our website. We will never ask for your password, full card details or one-time codes. Beware of anyone impersonating mistVCC; we are not responsible for losses caused by impersonators.

18Privacy and data retention#

We process personal data — such as your email address, login and security data (including IP addresses and device information), verification documents, transaction and support records — to provide and secure the Service, prevent fraud and abuse, and meet our obligations towards Issuers and under applicable law.

  • We share data only with parties that need it to provide the Service (for example Issuers, payment processors, hosting and communication providers) or where required by law.
  • Full card numbers and CVV codes are retrieved from the Issuer when you ask to view them and are not stored in our logs.
  • We retain data for as long as your account is active and afterwards for as long as necessary for legal, regulatory, accounting, fraud-prevention and dispute purposes.
  • You may request access to or correction of your data, or deletion where retention is not required, by contacting support.

19Intellectual property#

The Service, the mistVCC and Mist Network names, logos, design, software and content are owned by us or our licensors. You receive a limited, revocable, non-transferable right to use the Service for its intended purpose in accordance with these Terms. Card scheme names and logos belong to their respective owners.

20Changes to the Service and these Terms#

We may modify, suspend or discontinue any part of the Service at any time. We may amend these Terms at any time by publishing the updated version on this page and updating the “Last updated” date; where changes are material we may also notify you by email or in the panel. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service.

21Account security and recovery code#

Every account is issued an account recovery code (format MV-XXXX-XXXX-XXXX-XXXX). It is shown in the panel after registration and whenever required, and can later be viewed only by you under Account → Recovery code. It is the only way to reset your password yourself.

  • You are responsible for storing the recovery code safely (e.g. a password manager or a printed copy). Do not share it with anyone.
  • We will never ask for your recovery code via Telegram, email, support chat or any other channel. Anyone asking for it is not us.
  • Resetting your password requires a valid recovery code together with your account email. A used code becomes invalid and a new code is issued.
  • If you lose your recovery code, account recovery is handled through a manual security review and a USD 30 account-recovery fee is charged to your Account Balance. If your balance is insufficient, the fee may be collected later.
  • During the review we may request information and documents proving that the account is yours. We may refuse recovery if ownership of the account cannot be reasonably proven.
  • We are not liable for any losses resulting from lost, shared or compromised recovery codes, passwords or devices.

Manualidentity and ownership review

22Card withdrawals#

Withdrawing funds from a Card back to your account is not a self-service feature. It is offered as a manual service, subject to the following rules:

  • How to request: open a support ticket in the user panel stating the Card (last four digits) and the amount you wish to withdraw.
  • Manual processing: requests are reviewed and processed manually by our team within a reasonable time, normally 1–3 business days. This timeframe is an estimate, not a guarantee, and may be longer due to Issuer processing, verification or high volume.
  • Withdrawal fee: a fee of 30% of the withdrawn amount applies, with a minimum fee of $5 (USD) per withdrawal. The fee is deducted from the withdrawn amount.
  • Where the funds go: the net amount (withdrawn amount minus the fee) is credited to your mistVCC Account Balance.
  • The withdrawal amount cannot exceed the Card’s available balance after pending authorisations, and must be greater than the applicable fee.
  • Issuer and Payment Network limits (minimum or maximum amounts, frequency, holding periods) may apply and may prevent or reduce a withdrawal.
  • We may refuse, delay or limit a withdrawal — for example while verification is pending, where abuse, fraud or a dispute is suspected, where a Card is blocked or under review, or where the Issuer restricts it.
  • Completed withdrawals are final and the withdrawal fee is non-refundable.

23Governing principles and disputes#

If you have a complaint or dispute, you agree to contact support first and to give us a reasonable opportunity (at least thirty (30) days) to resolve it in good faith before pursuing any other remedy. Most issues can be resolved quickly through a support ticket.

These Terms shall be interpreted in accordance with generally accepted principles of commercial law and good faith, and in a way that gives the fullest effect permitted by the law applicable to you. Where any mandatory law that applies to you grants rights that cannot be waived, these Terms apply only to the extent permitted by that law. Claims must be brought individually and within one (1) year after the event giving rise to the claim, where permitted by law.

24General provisions#

  • Entire agreement: these Terms, together with any rules shown in the panel, are the entire agreement between you and us about the Service.
  • Severability: if any provision is found invalid or unenforceable, the remaining provisions remain in full effect and the invalid provision is replaced by a valid one closest to its intent.
  • No waiver: our failure to enforce a right is not a waiver of that right.
  • Assignment: you may not transfer your rights or obligations; we may assign ours, including as part of a reorganisation or sale.
  • Force majeure: we are not liable for delays or failures caused by events beyond our reasonable control, including outages of Issuers, Payment Networks, blockchains, hosting or communication providers, and acts of authorities.
  • Language: these Terms are published in English and Turkish, and both versions are binding. Translations into other languages are provided for convenience only. In case of inconsistency, the English version prevails.
